本研究は、教育行政学、教育史学において研究上の空白となっている就学義務制度の初期の手続き枠組み(学校教育法と同法施行規則)の構築された時期(1947年)から、現在の就学義務制度の手続き枠組みが政令において定立された時期(学校教育法施行令制定時期)(1953年)までの戦後の就学義務制度の手続き規定の形成過程を実証的に明らかにすることを目的としている。本年度は1947～1953年頃までの社会における就学問題を明らかにするために国立国会図書館、東京都立図書館等で収集した資料や当時の新聞資料を用いて分析し、(1)貧困さゆえの人身売買、家庭内労働、浮浪等による不就学、長期欠席、(2)労働する児童・生徒のための法律に規定されていない夜間中学、夜間学級の設置と就学、(3)よりよい教育を求めて移動する区域外就学、という3点が存在することを指摘した。戦後の就学問題は(1)、(2)について個々に論及されることがあるが、(3)を含めてその全体像を指摘したものはなく、重要な知見であると思われる。上記を踏まえた上で、中央政府における就学問題の認識の状況とその対応(制度化)を議事録、通達等の資料を用いて分析した。この結果判明したことは、(1)青少年の非行防止、「教育を受ける権利」の保障を追求する観点から就学問題(1)、(2)の是正に議論が集中していたこと、(2)「教育の機会均等」という理念は「全国的に標準化された学校の条件整備」という制度化を導いたこと、(3)この制度化の集中の一方で、就学問題(3)のように就学手続きを修正する課題は、学校の条件を標準化させることで「移動する必要がないようにする」という論理のもとで棚上げにされていたこと、の3点である。このような戦後における就学問題の解決の制度化、そして非制度化のプロセスについてはこれまでに十分には明らかにされておらず、今日の就学問題を考える上で重要な示唆を与えられたものと考える。以上の成果は研究成果報告書としてまとめている。

The solution of the problem of schooling is institutionalized and non-institutionalized. It is very important to examine the problem of schooling today. The above results are reported in the research results report.
