项目摘要

研究3年目の22年度は、これまでの研究成果をソーシャルワーク世界会議、社会福祉学会で発表した。また、サービスの質と権利擁護に関係しサービス利用契約の現状と課題を探るため、7施設・1団体を訪問し、事業者へのヒアリングを行い、契約書等の資料を収集した。さらに、これらの分析を行い、民法や権利擁護その他の文献研究を通して3カ年の研究のまとめに取り組んだ。(1) サービス提供事業者の契約に対する取り組みについて、事業者等へのヒアリング、収集した契約書等から以下のことが認められた。(1)事業者が、利用者との契約を通した権利義務関係の発生の意義を認め、契約締結をサービス利用の主要な入口として評価していること。(2)利用者の契約締結の支援、利用料支払い、入院や退所時の支援など契約を取巻く生活状況に課題があること。(3)身体拘束の禁止等国が定めた運営基準に基づく規定を除き、契約書の中にサービスの質に直接的に触れる規定が見あたらず、サービスの質の担保に課題があること。(2) 収集した契約書等資料の分析や文献研究の結果、以下の点が認められた。(1)利用者はサービスの受け手の地位から契約を通して権利主体としての地位を獲得したこと。(2)福祉・介護サービスの利用が契約関係を通して市民法上の権利として認められること。(3)利用者の契約締結能力、代弁、身上監護など、利用者の権利擁護が課題であること。(4)権利擁護ネットワークの構築を通してコミュニティー強化を展望。(3) 理論上の課題として、以下の点が挙げられる。(1)契約を通した福祉・介護サービスの利用への転換は、福祉・介護領域におけるパラダイム転換を伴う重要で基本的な変化であること、(2)福祉・介護サービス利用者が権利主体として認められることから、事業者・家族等の関係者は利用者の権利擁護に努める責任が生じていること、(3)市民法を中心とする「権利・法」概念とそのシステムが福祉・介護領域に進出したことから、福祉・介護領域では、利用者の権利主張と権利擁護が重要な課題として浮上していること。
