项目摘要

「研究の目的」に記載した通り、本研究は、(1)社会的な討議/闘技に開かれた過程において、(2)差異/再分配の承認をめぐる実践が展開される、したがって(3)非基礎づけ主義的なアイロニズムの地平に立つ、ポストモダンの法体制論へと批判法学を鍛えることを目指すものである。今年度は、「研究実施計画」に記載した通り、上記内容のうち(3)「地平」研究を中心としつつ、(1)「過程」研究および(2)「実践」研究を同時並行的に実施した。(3)について具体的には、前年度に引き続き批判法学の法的思考論「法的思考の系譜学」の再検討を行い、ニーチェ/ウェーバー的視点から現代の法的思考を把握する理路を深化させた。同時に、批判法学運動史についても検討を行い、現代の法的地平がアイロニズムに満たされたものであることをいわば理論外的視点からも明らかにするよう努めた。これらの成果は、現代の法体制がよって立つポストモダンの精神史的地平がどのようなものかをより重層的な仕方で明らかにするものである。(1)について具体的には、前年度に引き続き批判法学の法社会理論「ピンク・セオリー」を鍛える作業を行い、同理論をポスト・マルクス主義的法理論として把握する理路を解明し終えた。この成果は、まさしく批判法学に基づく法体制の記述を可能とするものである。また、(2)について具体的には、前年度に引き続き批判法学の実践論「脱正統化プロジェクト」の再検討を行うとともに、ダンカン・ケネディの法学教育論についても検討を行った。これらの成果は、批判法学の実践論の意義と射程をより十全な形で明確にするものである。

The purpose of this study is described as follows: (1) the process of social discussion/development,(2) the recognition of differentiation/redistribution, and (3) the establishment of non-basic legal systems.
