项目摘要

本研究の目的は、「各国法の本質的平等と多様性」という抵触法的正義を尊重する伝統的な抵触法方法論の現代的意義を再確認し、最近、国際的保護強化がより強調されている知的財産権分野につき、「法の抵触」の観点から、その妥当性を検討していくことであり、これを踏まえて、知的財産権の分野に限らず、他の法領域においても、国際私法研究の出発点となる伝統的方法論の正しさを検証し、その体系化を試みることである。平成23年度(正確には、23年4月から9月まで)は、昨年度同様、伝統的抵触法方法論の「内在的発展」を常に意識して行われた、抵触法方法論の体系化に関するこれまでの研究成果を発信していくことに注力した。まず、これまでの研究結果を一冊の本としてまとめた。『国際知的財産権保護と法の抵触』(信山社、2011年)がそれである。これは、知的財産権の国際的保護に関する博士論文での研究を基礎とするもので、国際知的財産権をめぐるこれまでの法的環境の変化と抵触法学の本質を踏まえて、知的財産権の国際的保護の最近の動きを如何に受け止めるべきかを検討したものである。その他の論文としては、既に執筆済みの「職務発明・職務著作に関する国際私法上の問題」、「国際物品売買条約(CISG)を中心としてみた条約と法廷地国際私法との適用関係」が、2011年韓国国際私法年報など近々韓国で公表される予定にある。そして、6月には、韓国最高裁判所(大法院)で開かれた韓国国際取引法学会・大法院国際取引法研究会共同学術大会に参加し、CISG上の買手の検査義務と不適合通知義務、外国仲裁判断の承認執行に関して、韓国国内の議論を聞く機会に恵まれた。抵触法方法論の体系化と関連しては、7月には名古屋大学にて、「伝統的抵触法方法論の深化と現代的意義の模索」というタイトルで報告を行った。

The purpose of this study is to reconfirm the modern significance of conflict law methodology by emphasizing the recent international protection and strengthening of the "equality and diversity of the essence of law in various countries" and the "justice of conflict law" and "respect for the traditional law of conflict."In the field of other law, the development of international private law research, the standardization of methodology, the systematization of the system, etc. In 2007, the research results of the "intrinsic development" of the conflict methodology were published and focused on the systematization of the conflict methodology. The research results of Ma Na and Kere Ma Na are published in one volume. "International Intellectual Property Protection and Conflict with Law"(Shinyama Society, 2011). The research foundation of the international protection of intellectual property and the nature of conflict law are discussed in this paper. He has authored several papers, including "Issues in Private International Law Related to Job Disclosure and Job Creation,""CISG,""International Sales Treaty," and "The Application of Private International Law to Law,""Korea Annual Report on Private International Law, 2011," and "Korea Public Report, 2011." In June, the Supreme Court of Korea (Grand Court) opened a joint academic conference of the Korea Institute of International Citation Law and the Grand Court of International Citation Law. The buyer's inspection obligation on CISG and the notification obligation of unsuitability, the recognition and enforcement of foreign arbitration judgments, and the opportunity for discussion in Korea were also attended. "Systematization and correlation of conflict methodology" was presented at Nagoya University in July.
