(1)具体的内容:本研究は、情報を対象とする刑事手続きの総則的なルールを探求するものである。具体的には、現在独米においては議論が高まっているいわゆる「オンライン捜査」(情報科学技術システムに密かに侵入し、情報を獲得する捜査手法)を考察しつつ、日本における「科学捜査」を巡る諸議論を検討しながら、総則的な立法論を視野に入れた「法益論の再構築」「令状主義の鉄則の再考」「情報令状の在り方」「令状による捜査のあるべき範囲の再考」という博士論文における4つの検討課題を明らかにしようとしている。なお、前記4つの研究課題を解明するために、平成22年4月～7月の間にドイツのマックスプランク外国刑法・国際刑法研究所に赴いて、専門家の訪問と資料収集を行った。(2)意義・重要性:本研究は情報社会により相応しい刑事手続の総論的な法規範の再構築に資するものと考えられる。具体的には、まず、物と並んで、情報をも直接の処分対象とする総論の機能としては、有体物のみを対象とする現行法の局限を打開すると共に、強制処分法定主義を柔軟化することができるから、それによって、新しい科学捜査の手法の類型化の困難と各論的な立法の欠如や不備という問題を解決しながら、各論的立法における時代遅れの法的保護の間隙を埋めることができることが挙げられよう。他方、本研究の提案した総論の適用範囲は科学捜査の場面に止まらず、その定義に当たる限り、非科学捜査にも適用でき、科学捜査と非科学捜査との形式的な区別を打破したうえで、各々の捜査行為の特徴に着目し、それぞれを適切に規制することができ、法体系及び理論の一致性を維持することができるというメリットがある。なお、複数の各論が存在する場合、総論はそれぞれの適用関係を調和することができるという点も本研究の実益の一つである。
