项目摘要

本研究の問題関心は、労働者派遣の法規制における派遣労働契約(派遣元企業と派遣労働者の間で締結される労働契約、以下「派遣労働契約」という)を基軸とする契約的アプローチの構築である。今年度は、本研究の最初に提示した問題意識を踏まえ、昨年度に行われた日本法と中国法に関する比較法的研究に引き続き、特にフランス法について研究し、本研究課題に関して試論を出した。フランスでは、派遣労働契約と労働者派遣契約に関する契約規制は、労働者派遣の規制全体において重要な規制軸となっている。また、派遣労働契約については、日本法や中国法と同様にこれを労働契約として位置付けているが、この種の労働契約と通常の二者間の労働契約の区別が意識され、派遣労働者の特殊な地位に応じた特別な規制が行われている。これに加え、この派遣労働契約と労働者派遣契約との間の緊密な関連性は非常に重要視されている。このような規制手法は、派遣労働契約の「実質性」を確保する及び「不完全性」を補うためのものであると解することができる。この特徴を、具体的には、派遣労働契約の締結前の段階の規制、その締結と効力要件、違反の場合の民事制裁、派遣労働契約の内容、終了時の派遣元の契約上の義務など広範な内容にわたってみることができる。これまでの比較法的考察を踏まえ、本研究課題について、中国法及び日本法に対して次のような示唆があった。(1)派遣労働契約の「実質性」の確保。派遣労働契約の成立及び展開段階において、派遣労働契約には労働契約たる実質を備えることを確保するための法規制が必要である。(2)派遣労働契約の「不完全性」の補てん。労働者派遣における使用者概念の二重性を意識しながら、それぞれが使用者としての関わり方や法違反への寄与に応じた責任帰属の手法が妥当である。(3)労働者派遣を、規制が必要となる外部労働利用力の利用における多様な形態の一つとして捉えることが必要である。

This study focuses on the construction of a contract based on the legal framework for the dispatch of workers (the contract concluded between the dispatch agent and the dispatch agent, hereinafter referred to as the dispatch contract). This study is aimed at exploring the comparative method of law, China law and Japan law. (1)Assuring the "quality" of dispatch contracts. The establishment and development of the dispatch contract is necessary for the quality of the dispatch contract. (2)The "incompleteness" of dispatch contract. The dual nature of the user's concept of dispatch is appropriate for the user's relationship with the law and for the responsibility of the user. (3)It is necessary to dispatch and regulate the use of external power.
