本年度、2本の論文が学術雑誌(ともに査読付)に掲載された。このうち、「「朝臣」小考」は、「朝臣」と署すことの使用実態と原理を追究したものであり、上島有氏(「草名と自署・花押-書札礼と署名に関する-考察-」『古文書研究』24、1985年)が挙げた署名原理(書札礼の原理・公験の原理)とは異なる新しい原理、公式令の原理の存在を明らかにした。またこの論文は日本王朝国家文書行政構造論で考える二層構造を補強する一面もある。検討対象とした様々な文書のうち、詔書・位記・太政官牒で用いられている「朝臣」は公式令の規定に則しているが、院庁下文・雑訴決断所牒で用いられている「朝臣」は公式令の規定を淵源としつつも、それだけでなく独自のアレンジを加えているからである。これは衙式文書で明らかにした文書行政構造と同じであり、新しい文書概念を考える上で、重要な手がかりになると考える。いま一つの論文「保元元年新制の古文書学的検討」であるが、保元元年新制は古代から中世への画期となる法令と評価されることがありながら、関連史料に錯誤があることが一つの要因となって、その発布時期・形式・範囲が判然としなかった法令である。本論文はその関連史料に見られる錯誤原因を突き止めた上で、その発布時期・形式・範囲を復元した論文である。この論文は保元元年新制に特化した研究であるが、中世公家法の施行過程を考える上でここまで詳細に復元した研究はなく、他の公家法にも考察対象を広げることによって、法令に関する文書論(文書行政論)を体系化する際の起点になると考える。
