養介護施設従事者等による高齢者虐待への市町村の対応能力向上に関する研究

高齢者虐待防止法に基づき、養介護施設従事者等による高齢者虐待(以下、施設虐待)が生じた場合は市町村が事実確認調査や改善指導などを実施する。しかし、これまでの施設虐待の研究は虐待が生じた施設や虐待を行った職員に関するものが中心であり、施設虐待に対応する市町村を対象とした研究はほとんどない。本研究は、施設虐待に対応する市町村の実態と課題、市町村への支援の必要性を明らかにすることにより市町村の施設虐待への対応能力向上を図り、もって被虐待高齢者の権利擁護に資することを目的としている。上記の目的のため、平成21年12月に全市町村(特別区、政令指定都市の区を含む)1963ヶ所と都道府県を対象とした調査票を用いた郵送調査を実施した。その結果、市町村748票(有効票735票)、都道府県35票(有効票35票)の返送があった。調査結果を分析して市町村の施設虐待への対応能力のために次の4つの提言をまとめた。(1) 市町村および都道府県は、施設虐待に対応するための準備を可及的速やかに行うこと。(2) 国は、虐待とはどのような行為を指すのかについての判断の指針を示すこと。(3) 国は、未届け老人ホーム、養介護施設ではない病院・診療所、介護付き高齢者専用賃貸住宅などでの虐待に対して、市町村および都道府県が法令に基づいて対応できるように高齢者虐待防止法を改正すること。(4) 国は、市町村と養介護施設が協力関係(市町村直営を含む)にある場合にも、適切に事実確認調査・改善指導等が実施されるような仕組みを検討すること。そして調査結果を還元するために、提言および市町村と都道府県の調査結果を載せた報告書を作成し、国、都道府県、全市町村に送付した。
