Police regulation against the abstract danger-Reserch about the control of the judgement of a legislator

传统警察法理论认为，警察对具体危险采取个别措施，对抽象危险采取立法措施。但在日本的法律的实践中，抽象危险并没有发挥重要作用。本研究试图厘清抽象危险的概念，建立立法自由裁量权的控制标准，并解释有效危险抗辩的司法制度。

According to the traditional police law theory the police takes an individual measure against a concrete danger and a legislative measure against an abstract danger. But in the Japanese legal practice an abstract danger doesn't play an important role. This research tries to explicate the abstract danger concept, establisch the criteria for the control of a legislative discretion and explain the judicial system of the effektive danger defence.
