Contemporary Functions of Compromise in Court and Its Legal Regulation

本研究主要通过对德法两国庭内和解法和庭外和解法的比较研究，在讨论庭内和解法的法律性质和法律效力的背景下，着重探讨当事人意图的意义和法官的作用，为今后庭外和解法的实践和立法提炼出一定的理论观点。

Through a comparative study mainly on German and French law concerning settlement in-and outside the court and focusing particularly on the significance of parties intention and the role of judges in the context of the discussion regarding the legal nature and effects of settlement in court, this research extracted certain theoretical viewpoints for the future practice and legislation on the settlement.
