Using Friedrich Carl von Savigny’s own manuscripts of his System of the Modern Roman Law (Systemdes heutigen Romischen Rechts, 1840), I considered the following three problems. First, the process bywhich the “plan” of System was formed; second, Savigny’s drafting of the “Preface” of System; and third,the process by which he formed his ideas regarding the jurisprudence of the sources of law(Rechtsquellenlehre) described in System. From this study, I was able to glean insight regarding thecharacteristics of the manuscripts and the period during which they were composed, as well as cluestowards elucidating the process by which System came to be formed.

利用弗里德里希·卡尔·冯·萨维尼自己的《现代罗马法体系》手稿（Systemdes heutigen Romischen Rechts，1840），我考虑了以下三个问题。第一，《体系》的“计划”的形成过程;第二，萨维尼对《体系》的“序言”的起草;第三，萨维尼对《体系》中所描述的法源法理学（Rechtsquellenlehre）的形成过程。从这项研究中，我能够收集到关于手稿的特点和他们创作的时期的见解，以及阐明系统形成过程的线索。
