A foundation study on discretionary power of the bankruptcy court from the perspective of governance of the insolvency

这是一项基础性研究，旨在探讨破产法院自由裁量权的合理性和可能性，并考察其在破产程序的某个阶段的体现。在这方面，我从破产治理的角度进行考察，这是一种现代分析视角，可能是日本第一次使用这一视角。这项历时四年多的研究成果偶尔会发表。第一部分是关于破产法院职能的介绍性研究，是在历史考察和比较考察的基础上进行的综合性研究。

This is a foundation study aiming to explore the justification and possibilities of bankruptcy court's discretion, and examine its embodiment in some stage of an insolvency proceeding. In this, I do the examination from a viewpoint of governance of the insolvency, which is a modern analytical perspective probably for the first time utilized in Japan. The research achievements on this over four-years study had been occasionally published. Most leadng one, An Introductory Study on the Function of a Bankruptcy Court, is a comprehensive based on historical and comparative examination.
