本研究の目的は、国際憲法論の観点から、「国際連合加盟国のこの憲章に基く義務と他のいずれかの国際協定に基く義務とが抵触するときは、この憲章に基く義務が優先する」と定める第103条の法構造を検討することである。本年度はまず第103条の法構造を解明するため、(1)「優先する」の法的効果(2)優先の対象となる国際法規則の範囲、という二つの論点を検討した。(1)について、「優先する」が抵触する規範を無効にするという立場と抵触する規範は一時的に適用不能になるにすぎないという立場の対立が見られたため、国連における実行や条約法条約(1969年)の関連規定などを詳細に考察した。その結果、後者の立場が現在の国際社会で受け入れられている解釈であるとの結論に至った。この研究成果は大阪大学大学院国際公共政策研究科の紀要に論文として掲載された。(2)についての主な問題は、憲章上の義務が他の協定(条約)にのみならず慣習国際法にも優先するのかどうかである。学説は優先を否定する立場と肯定する立場に分かれているため、同条の起草過程に加えて、規範抵触に関する一般的原則や同条を実施する国連安全保障理事会決議などを詳細に分析し、検討を進めた。すでに考察は完成しており、平成24年度に発行される大阪大学大学院国際公共政策研究科の紀要に論文が掲載予定である以上の研究の意義は、第1に、国連憲章第103条の実証的かつ包括的な分析を、冷戦後の国連の新たな活動をふまえて行ったことであり、第2に、今後第103条の理論的検討を行う上での素材を提供することである。
