A study of prohibition of discrimination in private law relations

在现代社会，歧视不仅成为劳动关系中的大问题，也成为其他私法关系中的大问题。在本研究中，笔者特别参考了德国关于禁止歧视的争论，认为歧视是对人格权的侵犯，是对社会参与权的侵犯，而不是对平等权的侵犯，从而确立了禁止歧视原则。根据保护基本权利的义务理论，构建了判断禁止歧视的要件及其救济的框架。

In the modern society, discrimination becomes the big problem not only in labor relations, but also in other private law relations. In reference to the Arguments about "das allgemeine Gleichbehandlungsgesetz" in Germany in particular, I established in this study the doctrine of prohibition of discrimination by considering discrimination to be the infringement of right of personality and an infringement of the social participation right not an infringement of the right to equality. According to the theory of duty to protect the fundamental rights, I built the frame to judge the requirements of prohibition of discrimination and its remedies.
