项目摘要

本研究は, 産科医療における「医療事故→再発防止→医療の質向上」の流れを維持するための医事法学による医療・医学支援の達成を目的とするものである。これまでの同類型の訴訟事例と産科医療の医療水準の変化の関係性を分析しつつ, 今年度も, 昨年度から引き続き産科医療補償制度の原因分析委員会により公表された「原因分析報告書」の開示請求を行い, 産科医や弁護士等の専門家に意見を聴取しつつ当該報告書の分析を実施してきた。産科医療補償制度では, ピア・レビューによる医療評価がなされる中で分娩時の脳性麻痺発症の原因の分析と再発防止が目指されている。制度の分析の中で医療者と法律家の考える「過失」の概念の違いなどが浮き彫りになっている。一方で, 両者が抱く共通の目的である医療安全については, 本制度における原因分析・再発防止の機能がいかに医療の標準化等に結びついていくか, その議論・各関係団体の動きの過程を取材・調査し, またそのための方法論(制度の在り方), 本制度による紛争予防・解決に必要な要素の分析等を医事法学的視点ならびに産科学的視点より行い, 各種学会にて報告・提言を行った。本成果の一部は, 日本医事法学会誌 : 年報医事法学にてまとめ, また, 医療安全の観点から一般向けの新書にて触れた。また, 産科医療補償制度の見直しにかかる議論も追っており, 本制度の法的性質をはじめとして本制度が有している法的問題, 今後起こりうる法的問題についての検証し, 本制度が有する医療安全・医療の質向上に向けて有する意義を法社会学的手法を用いながら実証的に分析を行ったとともに, 今後も継続が必要であることを確認した。
