项目摘要

研究第2年目の今年度は、面会交流援助、さらには共同監護と面会交流の連関に重点を置きつつ、次のように研究を進めた。まず、6月の段階で「ドイツにおける離婚後の共同監護と面会交流援助」と題し、比較法学会において報告を行った。本学会には、民法・ドイツ法以外の研究者も多く所属するが、そのような研究者から、広い視野に立ってこその指摘を、今年度の研究の早い時期に受けることができたのは有意義であった。一方で、民法・ドイツ法の研究者からも鋭い意見を受け、下記の論文を書き進めるにあたり、参考とした。論文としては、まず、第1部として、公益社団法人とNPOの2団体に対する昨年度のヒアリング調査を通して明らかとなった、日本の面会交流援助体制の現状および課題を公表した(『国際公共政策研究』17巻1号)。援助提供の契機にはじまり、援助の類型とその内容、利用者やケースの特徴について述べた。執筆過程では、昨年度得た情報を補足するため、各団体に追加の調査を行った。とりわけNPOでは、実際の面会交流を補助スタッフとして援助する機会を得、実際に目で見ることで、昨年度の調査時よりも活動状況を深く理解することができた。最後の小括部分では、2つの団体の活動に反映されている、それぞれの理念・特徴を整理した。以上の研究結果は、9月に関西家事事件研究会においても報告を行った。ここでは、研究者のほか、家事事件を扱う裁判官から、その後さらに研究を深めていくための示唆を受けることができた。そして、続いて第2部として、ドイツを比較法研究の素材として考察した結果を公表した(『国際公共政策研究』17巻2号)。「付添い交流のためのドイツ基準」の形成過程と発展の軌跡を追った後に、当該基準の内容と運用を詳述した。ここには、昨年度末に行ったドイツでのヒアリング調査(少年局、児童保護連盟)の結果も適宜織り込んだ。結びの部分では、ドイツの状況も参考にしながら、日本の面会交流援助の発展的課題を検討した。
