项目摘要

平成26年度の研究成果は以下の通りである。１）平成27年2月に、慶應義塾大学出版会より『大正期日本法学とスイス法』を出版した。近代日本におけるスイス法の影響というテーマのもと、「人物史研究」と「法解釈史研究」を交錯させるという方法を用いることで、近代日本の法継受研究に関する新たな見方を提示する事が出来た。また、今までほとんど研究がなされてこなかった穂積重遠の法学方法論に光を当てることで、大正期法学の独自性を描き出すことが出来、それについてのさらなる研究の必要性を強調することが出来た。なお、本書の出版に先立ち、平成26年6月には比較法学会学術総会（大陸法部会）にて、そして同9月には同志社大学日独法学交渉史研究会にて報告を行った。前者の報告では、スイス法の近代日本への影響について、これまでの研究と総括したかたちで行ったが、後者では、近代日本におけるスイスとの人的交流に注目し、スイス・日本両国の法学者たちによってスイス民法が日本法学界に紹介され、それが日本法学の自立を促す一助をなしたことに言及した。また、夏と冬の2度にわたり、スイス・ドイツにてスイス民法第1条および法律の欠缺補充に関する資料調査を行った。上記報告および資料調査で得た成果は本書に反映させた。２）平成26年9月には、チューリヒ大学主催「日本・スイス国交樹立150周年記念学術セミナー」に参加し、「日本・スイスの法学領域における学術交流」というタイトルで報告を行った。本報告では、法学領域における日本・スイス間の交流の端緒について紹介し、スイス法に関する現在と過去との研究傾向の比較を行い、今後の両国の研究者たちのなすべき課題について提案した。スイスの法学者たちとの対話を通し、両国のより積極的な共同研究の必要性を再確認することが出来た。

Heisei 26 years of research results are the following: 1) Published in February 2007 at the Keio University Press,"Taisho Japanese Law" The influence of modern Japan on the history of human beings and the study of the history of legal interpretation are intertwined. The necessity of the study of jurisprudence in the present period is emphasized. The publication of this book was preceded by a report by the Society for Comparative Law Academic Conference (Department of Civil Law) in June 2006 and by the Society for the Study of the History of Japanese Legal Studies in September 2006. The former reports on the influence of Japanese law on modern Japan, the latter reports on the exchange of Japanese law scholars, and the promotion of the independence of Japanese law. Data survey on Article 1 of the Civil Code and the deficiency of laws The results of the above report and data survey are reflected in this book. 2) In September 2016, the University of Heisei hosted the "150th Anniversary of Japan's International Relations" academic seminar, and participated in the "Academic Exchange in the Field of Law in Japan". This report is intended to introduce and discuss the current and past research trends in the field of law, and to propose proposals for future research topics by researchers in Japan. The need for active joint research has been reconfirmed.
