This research is a study of the reality and the meaning of political interpretation of Constitution in the United States and Japan. I demonstrate(1) recent practice of “Signing Statements” in the United States and its political implication(2) a reality of Office of Legal Counsel for the United States department of Justice, which assists executive interpretation of the Constitution, OLC’s recent effort to reform its procedure, and controversy over OLC’s normative function(3) how should Cabinet Legislation Bureau interpret Japanese Constitution, and(4) a structure of Governmental interpretation of the Constitution in Japan.

本研究是对美国和日本宪法政治解释的现实和意义的研究。本文主要论述了（1）美国近年来“签署声明”的实践及其政治含义（2）协助行政机关解释宪法的美国司法部法律的顾问办公室的现实、法律顾问办公室最近对其程序的改革以及关于法律顾问办公室规范职能的争论（3）内阁法制局应如何解释日本宪法，（4）日本政府对宪法的解释结构。
