The Application of Labor and Employment Law in Corporate Reorganization

在日本，由于最近一系列的立法活动，针对企业重整制定了两部不同的破产法：企业重整法和民事再生法。虽然员工待遇是企业重组中最重要的方面之一，但目前关于企业重组中员工待遇的研究却很少。本研究旨在通过比较日本和美国，重点关注劳动关系的处理、员工诉求以及员工代表在企业重整中的参与情况，对劳动雇佣法在企业重整中的适用进行全面分析。

In Japan, as a result of a series of recent legislative activities, there exist two distinct bankruptcy laws for corporate reorganization, Corporate Reorganization Act and Civil Rehabilitation Act. Although the treatment of employees is one of the most important aspects in corporate reorganization, there have been very few researches regarding the treatment of employees in corporate reorganization. This research is aimed at providing a comprehensive analysis on the application of labor and employment law in corporate reorganization by comparing Japan and the U.S., focusing on the treatment of labor relationships, of employees' claims and on the participation of employee representatives in corporate reorganization.
