项目摘要

今年度は、雑誌『西洋史学』の査読を経て、論説「ローマ帝国における皇帝立法の変容――アウグストゥスの婚姻法の適用対象と後代の皇帝によるその拡大――」の掲載が決定した（2016年度刊行予定）。この論説は、ローマ帝国の初代皇帝アウグストゥスが制定した婚姻に関する諸法律について検討するものである。議論の中心に据えたのは、それらの法律が、制定当初、いかなる人々を対象としていたかということと、後代の皇帝たちが適用対象を属州へと拡大する際の背景がいかなるものであったかということである。結論として、属州側のローマ化だけでなく、皇帝政府の構成員の変化が、帝国全土に共通の法律が適用されるようになる原因の一つであった可能性を指摘した。また、論説「2～3世紀のローマ帝国における勅答の効力――キリスト教文献における用例を手掛かりとして――」を雑誌『立命館史学』に投稿し、査読を受けている。同論説では、2～3世紀のローマ帝国において、どのような形式で発せられた皇帝の文書が法律と見なされていたかを明らかにするために、キリスト教父ユスティノスとテルトゥリアヌスが著した護教文献と、2世紀半ばの皇帝トラヤヌスが属州総督小プリニウスとの間で交わした書簡を分析した。その結果、ユスティノスとテルトゥリアヌスにおいて、皇帝が帝国の一属州での一事例に対して発した勅法が、他の属州でも有効な法律の一種として扱われているのに対して、トラヤヌスにおいては、特定の属州に宛てられた勅法を他の属州に適用することを戒めていることを指摘した。結論として、3世紀末までに、皇帝政府は、トラヤヌスの如き方針を放棄し、ユスティノスやテルトゥリアヌスと同じく、個別的な勅法を帝国全土に敷衍するようになっていたという展望を示した。なお、本研究に関しては、2015年12月に、古代史研究会大会にて発表し、そこでの質疑応答を踏まえて論説を執筆した。
