项目摘要

平成27年度は、西ドイツで1976年に可決された共同決定法の成立過程およびその理念的背景を検討した。従来の76年法に関する研究では、「管理職員」を含めた数的構成ばかり言及され、企業側に有利な法律だと評価されてきた。しかし、本研究で法案の作成過程をより詳細に跡づけることによって、企業家の利益を代表したと思われていた自由民主党（FDP）でさえ、その内部に共同決定制度を民主主義の進展と捉え、積極的に推し進めようとする勢力が存在したことが判明した。このことは、連立パートナーの社会民主党（SPD）において、ホルスト・エームケを中心に、「社会の民主化」という名目のもと、民主主義を国家統治機構に限定せず、社会全体を統制する原理として拡大しようとした動きと軌を一にするものであると言えよう。また、FDPが定めた共同決定に対する方針を1960年代後半の党内史料ににまでさかのぼって調査した結果、FDPが共同決定制度を求めた背景には、「多元的社会観」の定着があった。つまり、労・資という二大階級の利害を調整する役割を課せられていた共同決定制度であるが、戦後の高度経済成長を経て社会が多様化したために、それぞれの階級内の利害をより適切に多様な形で表明できるよう改善する必要があるとみなしたのである。その目的でFDPにより提唱された「管理職員」の導入は、よりミクロな単位での労働者参加という機能を果たしたが、逆に言えば、「労働者」というカテゴリーを制度的に細分化するという効果ももった。要するに、76年共同決定法は、多元主義的社会観を背景に、究極的には個人単位での社会参加を促進することで、社会全体の民主主義化を図ろうとした「68年」後の新たな政治理念の制度的表れの一つと評することができよう。こうして、80年代以降の新自由主義にも受け継がれることとなる「個人主義」の制度的定着の一端を、本研究は明らかにした。

This paper discusses the background of the establishment process and concept of the Common Decision Law in 1976.
