项目摘要

本年度の前半は、三つの研究を行った。第一に、水への権利の詳細な解釈である。関連する決議文に加え、判例や国連文書、その他の報告書などといった資料を用いて、水への権利の内容を明らかにする作業を行った。第二に、持続可能な開発目標（SDGs）の指標に関する研究を行った。公表されている資料や会議での関係者へのインタビューを通し、指標が持つ規制的作用を明らかにし、水への権利を実現するメカニズムとして位置づけられるか検討した。この研究成果は、3度にわたって研究会やワークショップの場で報告している。第三に、水への権利を水供給に関する国内公共政策として実施する上で、国際規範を運用用語へ「翻訳」する過程を記述するために、国際的なパートナーシップの活動を参与観察した。プロジェクトベースリサーチとして、国際水協会（IWA）にて在外研究を実施し、参加の概念について調査を行った。その内容は、実践研究としての側面とアウトリーチ活動としての側面を合わせた形で、11月にブエノスアイレスで開催された国際会議のワークショップの場で報告した。本年度の後半は、博士論文の執筆に注力し、これまでの研究成果を体系的にまとめなおした。まず、グローバル行政法の理論を発展させることで、「水のグローバルガバナンス」を行政として把握しうることを提示している。次に、水への権利をとらえなおし、グローバルな行政行為を方向付ける規範的基準として用いることが出来るとの考えから、これまで収集した資料を用いて、斬新な角度から当該権利の法的地位と内容を論じている。そして、水への権利から導かれた基準と比較する形で、投資条約仲裁や世界銀行、社会権委員会や持続可能な開発目標の監視メカニズム、パートナーシップなどの活動を、これまでの実証をまとめている。なお、博士論文の内容は、国際法研究会で報告しており、今後は出版に向けて準備を進める予定である。

The World Bank and the Social Security Commission are responsible for monitoring and verifying the activities of the World Bank and the Social Security Commission. The content of the doctoral thesis is determined by the report of the International Law Research Association and the preparation for future publication.
