项目摘要

本年度は、David Trubek、Kevin Davis等の論文等を参照しつつ、経済学・政治学・法学等の分野を中心に発展してきた「法と開発」に関する歴史的・理論的議論を整理した。それを参照しながら、現代における関連事例・先行研究を集めることに注力し、法多元主義及びフォーマル・インフォーマルな制度が動態的に変化するという立場から、権利ベースアプローチの影響及び重要性を模索することとした。特に、国家及び国際機関の法整備支援や開発プロジェクトによって、ローカルな法制度・慣習にどのような変化が生じたのかについての考察をジェンダーと女性の権利に着目して行った。中でも、米国の人類学者Sally Merryなどの文献に依拠しつつ、開発と人権の関係に着目し、開発における「権利ベースアプローチ」や「人権の主流化」の観点から、経済的社会的権利が開発プロジェクトの中でどのように扱われているかについて考察を行った。また、社会調査の実習として、国際人権法の国内化事例としてヘイトスピーチを例にとり、女子差別撤廃条約や人種差別撤廃条約の国内的適用や浸透についての質的調査を中心としたフィールドワークを行った。アウトプットとしては、学内の研究会のみならず、国内外での学際的研究ワークショップ参加などを利用し研究成果・進捗を報告し、積極的に様々な分野からのフィードバックを得ることとした。国立民俗学研究所特別共同利用研究員制度を利用し、法人類学・法社会学的な論文の書き方、調査の仕方などについて学ぶとともに、人類学やフィールドワーク等に関する指導を得ながら人類学関連文献について資料調査・収集を行った。また、ハーグ国際法アカデミーのサマーセミナーに参加し、講義やゼミで国外の研究者の最新の知見を得るとともに、研究の発表等も行い、国際法に関する図書資料の収集を行った。
