项目摘要

フィリピン・パラワン島における法人類学的なフィールドワークを継続実施し、村落や郡レベルの具体的な紛争事例の分析から、フィリピンのムスリム社会の慣習法、イスラーム法、国家法をめぐる多元的法体制の現状を把握し、ムスリム社会内部の法の多様性を明らかにした。また今回は、郡における市民登録制度についての調査をおこない、国家の枠組みの中で、「市民」としてのムスリムがどのように位置づけられているのかを具体的な現状から理解した。さらに、1970年代に編纂されたフィリピンムスリム身分法法典の翻訳および注釈作成、さらにキリスト教的な法伝統をもつフィリピン民法と当該法の比較検討を通じ、ムスリムの置かれている法的状況を分析した。一方、フィリピンのムスリムの国内移動、バランガイ正義法制度の適用の村落レベルまでの浸透、所轄件数の増大と内容の多様化、先住民権利法の適用によるパラワン島先住民、ムスリム、クリスチャンのエスニシティ状況の変化についての資料分析をおこなった。これらの変化は、地方のコミュニティ、国家・グローバルな状況の相互連関の結果生じており、そこには経済開発、先住民権利の法的承認、イスラームの政治的意味づけの複雑化といった要因が関係していることが明らかになった。以上の分析から、再度、国家における文化多元主義のあり方について検討する必要が認識された。2005年3月には、アメリカ合衆国バージニア州での国際政治学会第16研究会社会・文化多元主義部会の年次大会で、"Conflict Management at the Bottom : A Case Study of Political Pluralism in Philippine Society"という研究報告をおこなった。このような検討は、翻って日本という国家における文化的な多様性を社会的に実現可能なものにしていくための手がかりになるとも考えられる。

The analysis of specific cases of disputes in the field of legal anthropology, such as the implementation of laws and regulations in villages and counties, the understanding of the present situation of multidimensional legal systems, the diversity of laws within society, and the analysis of legal disputes in villages and counties. In the present case, the county registration system, the investigation system, the national organization system, the "citizen" registration system, the location system, the specific status quo, and the understanding of the current situation. In the 1970s, when the law was compiled, the author analyzed the status of the law. One side, domestic movement of the system, penetration of the application of the justice law system in villages, increase in the number of jurisdiction, diversification of content, application of the aboriginal law in the islands, data analysis of changes in the status of the system. The result of the interrelationship between the local government and the national government, the development of the national government, the recognition of the laws of the indigenous people, the political implications of the national government, and the important reasons for the re-transformation of the national government. The above analysis is necessary to understand the cultural pluralism of the country again.
