项目摘要

本研究の目的は、形式性と一般性を特徴とする法に対し、その硬直化を批判したナラティヴ法学のち県を現代法に導入する理論的枠組みを設定し、人文学的「知」を法学に再導入するにあたり、個別性を思考してきた「法と文学」研究をアメリカ法思想の伝統の中で検討し、現代哲学や文芸批評のち県を応用しつつ現代的に組み替えることである。この目的を達成するため、28年度は文献精読を基本にして、法思想における人文学的伝統の掘り起こしをおこなった。1年を通じてJames Boyd White、Robert Ferguson、Sanford Levinsonなどといった「法と文学」研究における重要な研究者の文献を精読しつつ、特に文芸批評家のショシャナ・フェルマンの所説を検討し、「本来的な意味の喪失」または「言語が真実に達する不可能性」と説明される「深淵」概念が法のなかで果たす役割について検討した。法廷におけるトラウマ症状による証言のし損ねが、本来は証言の欠如を意味するものであるにも関わらず有意味で雄弁になってしまう状況を、法的な語彙では語りえないものとしてドラマ的・文学的なるものとして評価しなおし、さらに国家創設の起源にある「法自体の暴力」は法の言葉では説明しえず、その起源にある空隙を埋め合わせるのは文学的な「寓話」であることを確認し、文学が法の起源にある深淵をそれを隠蔽する法と共犯関係を築きあげつつも、同時に暴いてもいることを明らかにした。これらの研究内容をまとめた論文1編をはじめとして、本年度は他に教科書共同執筆1編および学会報告2回、研究会等報告2回の成果を発表した。法学と文学の学際領域である「法と文学」の、これまでにない方向性の一端を示すことができた。
