项目摘要

従来の我が国のフランス憲法史研究は、全体的な研究の蓄積という観点からは、革命期及び第三共和制期以降の時代に関する研究は数多いものの、他方で第三共和制以前の時期についての個別研究や革命以降の歴史を通史的に論じる研究に乏しく、また近年ではフランス革命そのものへの関心の著しい低下が見られる等の点が指摘することが出来る。これに対して本研究では、１、各時代の代表的な法思想・法学説において、統治・国家・社会像、法及び権利・自由といった諸概念がどのように語られたのかという点を分析することを通じて、各時代に固有の近代フランスなるものの像を抽出することを試みた。２、同時に近代以降のフランスにおける憲法思想が各時代によって多様であり、また各時代が以前の時代に一定の影響を受けつつ、それぞれの時代が抱える課題に即した憲法思想を体系化していることを指摘した。３、そしてとりわけ19世紀前半及び第三共和制期後半の時期においては、これまでのフランス憲法学のイメージとして流布してきた、個人を基礎単位とし、法意思主義に基づく共和国フランスというそれとは異なる、社会学的思考に基づく憲法思想が説かれていたことを明らかにした。こうしたフランス近代の歴史を俯瞰的にとらえる試みはこれまでのフランス憲法研究においては類を見ないものであり、独自の貢献がなしえたものと考えている。なお上記の研究成果をもとに執筆した博士論文によって博士号を取得した。博士論文の内容については書籍化等によって社会に還元したいと考えている。
