今年度は、国際経済法と国際人権法の交錯の総論的枠組について補足的調査を加えると共に、特に「WTOと食糧に対する権利」という事例分析に主たる焦点を当て研究を進めた。本事例については2018年に最新の英語文献が2冊出版されるというタイミングに恵まれ、当該Ferguson文献とGruni文献を1つの軸として現時点での議論の到達点（意義と限界）を考察した。国際経済法については、関税及び貿易に関する一般協定（GATT）と農業協定を中心として、WTO法において食糧安全保障はどのように考慮され得るか、また当該考慮は食糧に対する権利の観点からどの程度まで十分と評価され得るか、検討した。具体的事例として、近年インド等の諸政府が拡大を進めている公的食糧備蓄政策に焦点を当てた。そのWTO法との整合性、特にWTOにおけるバリ決定採択後においても残されている課題を分析した。国際人権法については、食糧に対する権利の理論的性質および実施につき、より大きな文脈である社会権の実効性を巡る議論との関連に留意しつつ、考察を深めた。すなわち、この約30年間で一般的意見や関連判例等を通じて社会権の規範内容は相当に明確化されたが、国際経済法分野の関連実行において十分に主流化がなされているとは言い難い。その原因や潜在的な解決策に関する議論を分析した。本年度も研究課題を世界的な議論の中に位置付けて発展させることに意を注いだ。特に2018年6月には、イタリアに所在する欧州大学院（EUI）に趣き、人権法の夏季講座に参加した。社会権研究を世界的にリードする講師陣および他の参加者との議論を通じて、本分野の最先端の知見を把握すると共に、本研究課題についても貴重な示唆を得た。また、同大学の図書館も利用し、日本では入手しにくい先行研究や資料を収集した。
