项目摘要

本研究において、障害者雇用政策・立法をEU、イタリア、日本との比較法的視角に基づいて研究しようとするものであり、なかでも、障害者の職場での配置に着目して研究を行った。より具体的には、主として、日本の障害者雇用政策は、従来は、雇用率制度により障害者の雇用を促進しようとするものであったが、2013年の障害者雇用促進法の改正により、障害者差別禁止規制と合理的配慮（合理的配慮とは、障害者である労働者について、障害者でない労働者との均等な待遇の確保または障害者である労働者の有する能力の有効な発揮の支障となっている事情を改善するため、その雇用する障害者である労働者の障害の特性に配慮した職務の円滑な遂行に必要な施設の整備、援助を行う者の配置その他の必要な措置を講ずることをいう）規制が設けられた。本研究では、より具体的に、日本の障害者雇用政策がどのように変化していたかの分析を試みた。ここでの分析においては、とりわけイタリアでの障害者雇用政策の展開（イタリアでも、障害者雇用政策が雇用率制度と障害者差別禁止規制の2つの柱から構成されている）との比較において行った。上記の研究の実施にあたっては、外国人特別研究員が主として資料や裁判例の収集、当該研究に関連する実務家（管理職や労働者など）へのインタビューの計画の立案等を行い、研究代表者は、日本の資料や裁判例の収集方法やその解釈の仕方、日本社会の基本的な構造や日本の歴史の理解の仕方等について助言をした。また関連する研究会を紹介し、多様な専門家と議論することをすすめた。そのうえで、外国人特別研究者の研究の進捗状況等を逐次把握する機会を設け、議論を行い、研究成果のブラッシュアップの作業を共同で行った。
