项目摘要

本研究は、オーフス条約の基準に基づいて、都市計画及び戦略環境影響評価(Strategic Environmental Assessment、以下SEAという)における参加の仕組みと司法制度について日本と台湾の問題点を明らかにし、イギリスの法制度を参考にしながら、仕組みの改善提案をすることを目的としている。都市計画は都市空間秩序を形成し、その決定が環境、財産権等、様々な利害関係に影響を与える。多様な利害関係の調整や環境配慮等の公共性の確保のために、都市計画段階でのSEAの実施、それに対する市民参加や司法救済が必要であるが、日本と台湾では制度上の課題が山積している。オーフス条約は環境分野の市民参加に関するグローバル・スタンダードともいうべき条約であり、都市計画を含む環境関連の計画の参加と救済制度に係る基準を示している。また、イギリスはオーフス条約の加盟国であり、条約の遵守メカニズムを契機とする制度改革、判例の展開等の効果が認められ、日本と台湾にとって参考となる点が少なくない。今年度は、オーフス条約履行ガイドやオーフス条約遵守委員会の判断に照らし、都市計画を含む環境関連の計画に係る公衆参画と司法救済の条約規定を考察し、具体的な内容を明確化した。その要点をまとめると、①2週間以上の参加期間の確保、②公的機関が特定の案を選択する前の早期段階での公衆参画の確保、③参加の結果を十分に考慮したことを示す方法を定めること、④都市計画及びSEAの争訟可能性、⑤環境NGOの原告適格の承認、⑥仮の救済の可能性、⑦実体的及び手続的適法性の司法審査等が要求されている。上記の基準に照らし、日本と台湾の都市計画とSEA制度並びにそれに関する参加及び司法救済の問題点を明らかにするとともに、イギリスの都市計画及び持続可能性評価制度を研究し、関連する判例を分析して、イギリスの制度の到達点と課題を検討した。

This study aims to address the issues of Japan and Taiwan in terms of treaty benchmarks, urban planning and strategic environmental Assessment (SEA), participation in the legal system, and suggestions for improvement of the legal system. Urban planning affects the formation of urban spatial order, the decisions of environment, property, etc., and the interests of urban planning. The adjustment of multiple interests, environmental considerations and other public security issues, the implementation of the SEA at the urban planning stage, and the need for public participation in judicial rescue, Japan and Taiwan, have accumulated. The environmental division of urban planning and the participation of citizens in urban planning and rescue systems The treaty's member states, treaty compliance, institutional reform, case law development, etc. are recognized, Japan, Taiwan, etc. This year, the Treaty Compliance Committee's judgment on the implementation of the Treaty will be reviewed, and the specific contents of the Treaty on Public Participation in Urban Planning and Environmental Protection will be clarified. Requirements include: (1) ensuring participation for more than two weeks;(2) ensuring public participation at an early stage before public authorities select specific cases;(3) giving due consideration to the results of participation;(4) determining the method of presentation;(5) the possibility of litigation in urban planning and SEA;(5) the recognition of plaintiff eligibility of environmental NGOs;(6) the possibility of rescue; and (7) judicial review of the legality of actual and manual cases. The above-mentioned benchmark urban planning and SEA system in Japan and Taiwan are related to the problem of participation and judicial rescue.
