本研究は国際刑事法における法解釈について、とりわけ一般国際法との差異に着目して、その特質を明らかにすることを試みるものである。研究計画調書においては、平成31度中に研究成果を公表し、また国際刑事裁判所にて実務に携わることを予定している旨を記した。本年も引き続き，国際刑事裁判所（ICC）における賠償命令に関する規定（規程第75条）を中心に研究を行った。とりわけ、賠償命令の法的性質に関する裁判所の立場と、そのことが一般国際法上の個人の地位に与える影響を意識し、研究を進めた。これまでの研究成果を取りまとめた論文については，2019年8月刊行の国家学会雑誌第132巻7・8号に論文「国際刑事裁判所(ICC)における賠償命令の法構造 : 国際法の個人に対する直接の刑事的規律の新展開とその限界」が掲載された。また、2019年8月1日から2020年1月31日にかけては、国際刑事裁判所第一審裁判部でインターンする機会を得た。その間、裁判所の日々の実務に携わることで、特別研究員としての研究課題に係る事項について、実務上どのように取り扱われているかについて一定の示唆を得ることができた。これと並行して、近年の国際刑事裁判例の内、とりわけ財産の破壊が問題となる事例において、規程上の犯罪の解釈手法とその過程における罪刑法定主義原則の機能についての研究も進めた。この成果をとりまとめた論文は、2021年刊行の雑誌に掲載される予定である。
