项目摘要

本研究は、わが国における抗告訴訟の理論構成ひいては行政法理論全体にとって適法性の原理という客観的要素がいかなる役割を果たしうべきかという問題意識のもと、フランス法の理論と経験から日本法に対する有益な視座を提示しようとするものである。具体的には、フランス越権訴訟における行政過程と裁判過程の連関という視角から、①行政に対する「申請」（権）概念の再考、②フランス法における手続違法の取消の現代的潮流の考察、③フランス法における裁判上の和解・認諾の実態と手続の解明、④コンセイユ・デタ調査部を中心とした判決後の執行担保のありようの分析、という課題を設定している。今年度は、上記③にあたるフランス法における行政上の和解の法理論の解明を目指し、近時の関連法令の改正を手掛かりにした研究を進めた。フランス行政法における和解については、近年ようやく学説上の議論が発展してきた様相であり、なおも理論的に不明な点は残るものの、コンセイユ・デタの判例法理の蓄積もすすみ、一定の理論的示唆を得ることが可能になっている。①法改正の概要を含めた現在の法制度の整理と問題の所在の明確化、②判例法理の分析を通じた和解の限界に関する考察をすすめ、①に若干の歴史的叙述を加えたものを、成蹊法学98号（2023年6月刊行予定）に掲載する予定である（脱稿済。99号に論文の後半部分を掲載予定）。
In this study, the whole theory of administrative legal theory is based on the theory of administrative law.
