项目摘要

本年度においては、まず、多国籍企業の責任に関するドイツ国際私法上の議論について整理した。ドイツ国際私法上、海外子会社の人権侵害に関する親会社の責任につき、原則的準拠法たる結果発生地法（ローマⅡ規則４条１項）の適用を排除すべきか否か議論がある。排除のためのアプローチとしては、回避条項（同規則４条３項）の適用、公序条項（同規則26条）の適用、ドイツ法の介入規範としての理解（同規則16条）等が議論の対象となっている。また、ドイツ企業の責任が問われたJabbir et al. v. KiK Textilien-und Non-Food GmbHは、企業による人権侵害の問題において、回避条項、公序条項等により、消滅時効の観点において被害者に不利な外国法規定を排除することの是非という論点を提示している。以上のドイツ国際私法上の議論を踏まえ、日本の国際私法について、公序条項の適用による原則的準拠法たる結果発生地法（法の適用に関する通則法17条）の排除を提案する。その根拠は、多国籍企業に対する抵触法レベルにおける国際的規制の必要性に求められる。また、公序条項の適用の根拠は、憲法98条2項所定の国内法の国際法適合解釈義務にも求められる。ただし、単に消滅時効の期間の短さをもっては、国際的規制の必要性、および、人権条約の観点から公序条項の適用を肯定することはできない。回避条項に関しては、その機能は抵触法的保護のみに限定されるべきであるとの理由から、その適用は否定される。介入規範の論点に関しては、日本法を介入規範として適用することは、刑事制裁等を欠く現行法を前提とする限り、難しいと考えられる。本年度は、以上のように、ドイツ国際私法上の議論を手掛かりとして、多国籍企業の責任に関する日本国際私法上のアプローチのあり方について検討を行った。

The duration of the treaty's termination is short, and the necessity of international regulation is affirmed. The avoidance clause is related to the protection of the law. The argument of intervention norms is related to the application of Japanese law, criminal sanctions, etc. This year, we will continue to discuss the above issues in private international law and the responsibilities of multinational corporations.
