本研究は、労働基準法第68条のいわゆる「生理休暇」についての議論が、特に1978年の労働基準法研究会第2小委員会が提出した労働基準法研究会報告書と、男女雇用機会均等法の制定によって停止させられたことを定量的に明らかにするものである。そのうえで、日本においてはその後の女性労働者のリプロダクティブ・ヘルス/ライツに関わる課題の解決が停滞していることを定性的に解明する。令和４年度には、労働基準法研究会第2小委員会が1974年に提出した『医学的・専門的立場からみた女子の特質』、また、1978年に提出した労働基準法研究会報告書を入手し、内容の定性的な考察をおこなった。さらに、当時の研究論文や新聞・雑誌記事から生理休暇に関する議論の定性的な分析をおこなうべく、資料収集を実施した。「保護と平等」をキーワードとして資料収集をおこなうことにより、1970年代から1980年代までは盛んに取り上げられていたいわゆる「母性保護」、特に生理休暇と男女雇用機会均等法との関係性の議論が、1990年代以降急激に減少したことが考察できた。労働基準法の女子保護規定の取り扱いが議論の焦点であり、本研究は、母性保護が男女平等の前提条件であるとして「保護も平等も」を求めた当時の運動に着目して分析を進めていく。また、本研究が着目する女性労働者のリプロダクティブ・ヘルス/ライツに関わる課題は、今改めて社会政策の課題として取り上げなければならない。社会政策では労働分野と生活分野が両輪となるが、本研究はそれらをつなぐ＜生きるために働く＞という問題意識に立っている。特に女性に着目することで、セクシュアリティの観点から、世代間の再生産の前提となる、労働力の再生産、特に生殖に関する健康の問題に深く言及することが出来る。本研究は、社会政策研究におけるリプロダクティブ・ヘルス/ライツに関する課題解決に寄与すると期待できる。

This study is based on the discussion of Article 68 of the Labor Standards Act on "Physiological Leisure," especially the report of the Labor Standards Act Research Committee submitted by the Second Subcommittee of the Labor Standards Act Research Committee in 1978, and the formulation of the Equal Employment Opportunity Act for Men and Women. The problem of solving the problem of female workers in Japan is still unresolved.
