项目摘要

本研究は、著作権をめぐる議論が活発に行われ、法改正や国際条約の制定も行われた１９世紀から２０世紀後半の時代に力点を置きつつ、１７世紀以降今日に至るまで、何が文学者の創作への原動力となったのか、そしてそれぞれの時代の著作権法は彼らのインセンティブを高めることが出来たのかについて、文学者に着目したケーススタディを行い、文学者と著作権の関係についての具体的で包括的な研究にまとめることを目的としている。本研究の初年度である２０２２年度には、１９世紀後半から２０世紀の前半にかけて活動した文学者についてのケーススタディを行った。この時代は、英国国内では、出版から４２年もしくは、著作者の死後7年までのいずれか長い期間、著作権を保護することとした１８４２年の著作権法改正の後、１９１１年に著作権法が改正されるまで、著作権の保護期間においては大きな進展はなかったものの、二国間条約や多国間条約により、国際間の著作権も保護されるようになってきた時代である。また、財産の所有の形と社会との関係について、広く人々が関心を持ち、議論が行われてきた時代でもある。このような時代の中、ジョージ・バーナード・ショウ、H. G.ウェルズなどのフェビアン主義者、ウィリアム・モリス、ジョージ・オーウェルなどの社会主義的思想を持っていた文学者たちが、所有権の一形態である著作権についてどのようにとらえ、創作活動を行ったかについて、ケーススタディを行った。
