项目摘要

本研究の目的は、「子どもを出生させてなぜ良いのか」という、一見自明にも思えるテーマを主として法哲学的視角から検討することによって、現代的再構築が迫られている親子法制の基礎理論を主として提供することにある。児童虐待防止制度の構築などに象徴されるように、深刻な現状意識から親子法制の問い直しが求められている。親子法制の課題とは出生後の事柄だけではなく、出生前診断をめぐる選択的人工妊娠中絶問題や人口増加・減少問題など、「出生そのもののありよう」という論点にも広がっていく。この論点に十分に対応するためには、出生に関わる当事者の同定、関連価値・利益の同定、さらには、出生正当化理由の整理・検討をはじめとした哲学的検討が重要となってくる。申請者は年来にわたって、子どもの権利論および子どもの道徳的・法的地位について種々の角度から検討してきており、申請者の研究領域を生殖倫理学（procreative ethics）へと広げることによって、子どもの道徳的・法的地位論の国内における新たな先行研究開拓を目指し。初年度の研究を行った。初年度である2022年度においては、問題構造を概観しつつ、生殖に関連する諸問題の共通構造、当事者関係のありよう、子どもの権利や生殖権の概念整理等、多領域にわたって錯綜する問題・論点の整理作業を行った。そしてその成果を子どもの権利論という視点からの学術論文「子どもの権利を尊重する意味」（『教育と医学』2022年 811号）として中間報告的にまとめた。
