少子高齢化の影響が最も深刻なわが国では、高齢者住まい施設の需要が急増し、社会的重要性も高まっている。そこで本研究では、社会保障法を根拠法とする高齢者住まい事業の租税法上の解釈について両法の関係性から解明し、効果的で持続的な社会福祉制度と税制のあり方について提言を行うことを目的とする。この目的を達成するために、本研究では租税法における高齢者住まい事業の性質について、公益性と課税の公平性の観点から、各事業に係る複数の根拠法を横断的に分析し、国際的な議論を交えて検討する。本年度は、高齢者住まい事業について、社会福祉制度等から租税法と社会保障法の関係性を分析することに着手した。まず、本研究における問題意識の中核となる判例のほかに、これまでの社会保障法と租税法の判例を収集してそれらの論点整理を行うとともに、関連する社会保障法の改正の変遷の把握を行った。具体的には、本研究の対象となる高齢者住まい事業として、養護老人ホーム、軽費老人ホーム、介護付有料老人ホームなどの性質を法令および通知等から分析し、概括的な比較をすることができた。本研究では、テーマ設定を「法人税法における高齢者住まい事業の性質」に限定しているものの、同事業の性質を把握するためには、社会保障法を規制・手続きの観点から横断的に検討する必要があることから、本年度は判例・学説の収集とその分析、関係法令の整理に努めたため、詳細な検討結果を得られたわけではないが、研究の基盤を構築することができた。
