本年度は、概ね緊急事態の理論についての検討に注力した。英米法には、緊急事態における権力の濫用を厳に戒める法的伝統がある。日本の先行研究を検討してみると、英米法のマーシャル・ローの法理について、それがリベラル・デモクラシーに適合する思考様式であると高く評価しつつも、特に国会主権がない日本を含む他国への導入可能性については否定的に評価する傾向があった。ダイシーによるマーシャル・ローの説明を読むと、イングランド臣民の自由は緊急事態においても解除されるものではなく、万やむなくしてそうした自由を侵害した場合、当該公務員は様々な制裁にさらされる。ただ、万やむをえないということが証明された場合には、刑事責任や不法行為責任を免除される。実際には、国会が免責法を制定することによって責任を免除されるというのが一般的である、というものである。この考え方は、国会主権が存在するイギリスでこそ意味があり、そうでない国では利用不能である、というのが先行研究の趣旨である。もっとも、ダイシーのような考え方は、国会主権の存在しないアメリカ合衆国においても取り入れられる余地がある。オレン・グロスの知見を借りると、真の問題は、国会主権云々といった側面ではなく、公衆の立憲主義へのコミットメント、緊急事態後の審査のあり方、公務員の答責性といった点に存する。今年度の研究成果については、次年度中にすみやかに公表していきたい。

The main theme of Japanese law is to include the possibility of introduction into other countries. The civil servant's freedom is violated when the civil servant is punished. In case of criminal responsibility, the responsibility for wrongful acts shall be exempted. In the meantime, Congress has enacted a law on exemption from liability. This means that there is no way to use it, and that there is no way to study it first. The United States of America has a lot of room for change. The public's constitutionalism, post-emergency review, and accountability of civil servants. This year's research results are in the middle of the year, and the next year's research results are in the middle of the year.
