平成23年民訴法等改正と平成30年人訴法等改正により、わが国の国際裁判管轄規定の整備は一応完了した。今後行われる個々の規定をめぐる議論においては、全体の整合性を確保しバランスに配慮した議論をするために、管轄法制全体をにらんだ基礎理論からの分析が重要となる。そこで、財産関係事件と人事・家事事件とで、このような基礎理論が共通するか、異なるかにも着眼して、横断的検討を行うのが本研究である。今年度は、特別の事情の考慮による国際裁判管轄の個別調整のあり方に関して、予備的な調査、検討を実施するにとどまった。そもそも、わが国の国際裁判管轄法制は大陸法系であるにも関わらず、英米法系のような、管轄の個別調整の仕組みが認められている特徴がある。これは、財産関係事件のみならず、人事・家事事件についても同様であり、両者に共通するる。もっとも、人事・家事事件については、離婚の際の子の親権者指定について、子の最善の利益を考慮すること、場合によっては一部申立てのみ却下するなど、財産関係事件とはやや異なる議論がなされている。このような議論は、管轄に関する問題であるか、訴えの利益その他の管轄以外の事情を考慮したものであるか、判別を困難とし、特別の事情の位置付けを再検討することを促すものであり、すでに財産関係事件の民事訴訟法3条の9に関する新たな議論の展開においてもその萌芽が見られるものである。以上の予備的考察に基づき検討を更に進めて、次年度以降に成果として公表する予定である。
