项目摘要

1997年のアムステルダム条約が1999年5月に発効して、国際私法は民事司法協力としてEC条約第4編へ移動し、ECが権限を有するようになった(EC条約65条)。民事司法協力に関するECの立法は、当初は国際民事手続法に関するものばかりであった。ブリュッセルI規則に代表されるこれらの共同体立法は、実際には既に発効あるいは未発効の構成国間の条約を規則化したにすぎない。このような状況から、アムステルダム条約による国際私法の共同体化は、当初は狭義の国際私法の調和よりもむしろ、裁判の相互承認原則を重視して、国際民事手続法を中心にしたものになるかと思われた。しかしながら、裁判の相互承認原則それだけを単独で実現するのは困難である。他の構成国の裁判を承認するためには、構成国間で実体法の側面及び手続法の側面での調和が進まなければ、公序条項の発動をいたずらに招くだけである。実際、実体法の側面では、狭義の国際私法に関する共同体立法作成の動きが始まりつつある。例えば、契約準拠法に関しては、既存の1980年のローマ条約(通称ローマI)を一部改正しつつ規則化するための、グリーンペーパーが提示された(COM(2002)654final)。また、契約外債務の準拠法に関する規則(通称ローマII)に関しても、規則の前草案が提示された。このように、欧州統合は国際私法の全域にわたって影響を及ぼしている。さらに、民法などの実質法にまでどの程度の影響をもたらすかは、なお未知数である(ヨーロッパ契約法に関しては、2001年9月11日の委員会の報告(COM(2001)398final)を参照)。
