主権免除をめぐる国際法と国内法の相克を明らかにする本研究課題は、（1）韓国における対日戦後賠償訴訟の動向、（2）ドイツ主権免除事件ICJ判決以降のイタリア国内法・国内判例の意義、（3）米国外国主権免除法上の国際法違反行為免除例外規定に関する判例、（4）制限免除主義が妥当する執行免除が拡大している根拠を検討している。当該年度においては上記のうちの（1）と（4）を中心に検討した。（1）については、韓国大法院徴用工事件判決以降の日韓請求権協定の解釈をめぐる議論を踏まえて、日本の裁判権免除を否定する判決とその後の強制執行手続、日本に裁判権免除を認めた判決とその後の裁判の状況、人身売買から生じた損害賠償訴訟の被告となる外国国国家に裁判権免除を認めないとする法改正案の韓国国会審議過程の検討を進めた。こうした検討を踏まえて、昨今の日韓外交関係の動向を踏まえながら、研究成果を取り纏めている途中である。（4）については、米国のいわゆる「クラウド法」（米国国内の企業が管理しているデータの保存場所が米国国外であっても米国捜査当局が強制的にアクセスするための司法手続を明確化する米国法）と主権免除の関係を検討した。米国捜査当局が強制的にデータにアクセスするためには裁判所から令状を取得するときに、米国の外国主権免除法に基づき、主権免除が適用されるので、米国の裁判管轄権は及ぶことがなく、米国裁判所は強制的なデータアクセスを認める捜査令状を発行することができないという説明をする者がいるが、民事訴訟における国内裁判所の管轄権行使を制限する裁判権免除では説明できない主張であり、むしろ執行免除を拡大させようとする側面を有している。こうした主張を精査し、主権免除の射程を明らかにする検討を進めた。
