项目摘要

本研究の目的は、市民参加型司法制度である裁判員制度の問題点を明らかにし、制度改革に向けた改善策を提言することにある。本研究を進めるにあたって、1年目においては、当初の予定では、参審制型の司法制度を採用している諸外国において指摘されている問題点や制度の改善に関する比較法制度研究を進める予定としていた。しかし、対象国として考えていた諸国において英語による情報提供が限定されており、資料の入手と読み込みに時間が必要なことがわかったことから、当初2年目に実施する予定であった計画を前倒しし、1年目に実施することとした。本年度は、「裁判員経験者の意見交換会」に関する議事録を分析対象とし、特に、裁判員によって指摘された制度の問題点に関わる発言に焦点を当て、質的分析を進めた。特に、本年度は「公判審理のわかりやすさ」に関して分析を進めた。まず、裁判員経験者の発言からは、裁判員が検察官と弁護人による訴訟活動のみによって審理を理解するには難しい部分があること、その不足する部分を裁判官による説示によって補っているという結果が得られた。特に、公判審理における弁護活動については、制度開始当初だけでなく、近年の記録においても、弁護人による訴訟活動の問題点を指摘する裁判員の発言が未だに見られる。この点については、検察官は組織として訴訟活動に当たっているのに対し、弁護人は個人として対応していることが理由として挙げられることが多い。しかし、そのような準備のための時間、裁判員裁判の経験回数や訴訟スキルの差に還元して良い問題であるかについては検討の余地があると考えている。引き続き資料の分析や考察を進めていく予定である。本年度の研究結果の一部については、国際学会と国内学会において研究発表をする機会をいただいた。研究者や実務家の方々から貴重なコメントを得ることができたため、今後の研究に活かしていきたい。
