本研究は、アメリカ統治下の沖縄における米軍刑事裁判所の機能を実証的に解明しようとするものである。沖縄を占領した米軍は、沖縄住民に対して一方的に刑罰法令を発布して刑事裁判権を行使した。琉球大学附属図書館にその裁判記録の複写資料が保管されている。本研究は、その記録を整理し、占領政策の変遷過程と関連付けながら、どのように占領刑法が沖縄の住民に対して運用されたのかを調査する。初年度は、裁判記録のスキャニング作業を進めたほか、米軍法令の売春罪について研究ノート「戦後米軍刑法と強制売春（４）」「同（５）」の２編をそれぞれ琉大法学１０６号及び１０７号に発表した。前者で紹介した資料は１９６０年代以降の琉球政府裁判所で審理された営利誘拐罪や児童福祉法違反事件のうち売春に関するものであるが、これを用いて１９５０年代の米軍刑事裁判所における売春等事件との比較を行い、１９６０年代の沖縄で、売春をする者に対する売春を理由とする差別的取扱いがみられるのは、１９５０年代に米軍法令の売春罪が差別的に運用されていたからであることを示唆した。後者は、沖縄の米軍法令の売春罪が売春差別を作出・助長したとの認識に基づき、売春が違法であるか否かではなく、売春差別の違法性を問題にすべきことを指摘した。売春の廃止主義によれば、売春が性的な被害として経験されるのは、買春行為に性的な暴力性があるからである。しかし売春罪等の犯罪歴の取消嘆願書を検討したところ、売春の経験が語られにくいのはむしろ売春差別があるからであることが理解できた。

This study aims to clarify the function of the criminal tribunal under the jurisdiction of the United States Army. The criminal justice system was established to deal with the occupation of the United States and the population. The duplicate data of the judgment records of the University of the Ryukyus affiliated library are kept in storage.
