今年度、本研究テーマに関する議論として、法制審議会（家族法制部会）において、離婚後の子の養育に関する議論が進められており、家族法制部会における議論を読み進めた。ただし家族法制部会においては、養育費の不払い問題を重要な課題と認識しているものの、民法の枠外で対処すべきであるとの位置づけであった。ドイツの扶養料立替制度の理解としては、概説書であるChristianGrobe『UVG:Unterhaltsvorschussgesetz』(2020)を読みすすめ、改めて制度の概要の理解をするとともに、その中で引用されている論文等についても収集し（“Kommentar zum Sozialrecht”等）、本研究に関連する個所を読み進めた。特に、本年度の研究題目である「モラルハザードへの対応」との関係では、扶養義務親に対して求められる「期待可能な努力」、監護親に対して求められる「高度な協力義務」について、それぞれ具体的にどの程度必要とされるのかという点から議論を取り上げた。裁判例についても公表されているものを雑誌「Zeitschrift fur das gesamte Familienrecht」を中心に、網羅的に読み進めた。裁判例では、匿名精子提供により出産したシングルマザーの養育費立替請求が認められなかった事例（VGBerlin2022.10.25）が公表されおり、これまでの類似の裁判例とともに、その点について掘り下げて研究を進めた。
