本研究は、弁護士及び医師との委任契約を素材として、専門的受任者との委任契約において事務処理方法の特定に向けた委任者の要求が受任者の裁量に及ぼす影響を明らかにすることを目的とする。委任事務の内容が高度に専門的である場合、委任者の要求を契機として、受任者が委任者意思を確認し、委任者の要求を「指図」へと明確化することが必要となる。本研究では、委任者の意思決定はいかなる対象に及ぶのか、「指図」へと明確化される以前の委任者の「要求」はいかなる法的作用を有するのか、医師と弁護士とではその裁量枠組みにいかなる違いがあるのかを明らかにすることが重要な意味を有する。そこで、2022年度は特に診療契約における治療方針の決定に関する医師の裁量と患者の意思決定との関係に焦点をあて、考察を行った。患者の承諾は、治療行為の受入れに関する自己決定としての性質と侵襲行為の違法性阻却事由としての性質を備えており、これと関連して患者の意思決定の対象も治療行為の身体への受入れに向けられたものとして把握されてきた。本年度は、この把握方法が、医師は治療方法の決定について裁量を有するとする従来の理解との整合性を維持しつつ、医師の説明義務の範囲に限定を加える役割をも担ってきたことを明らかにした。そのうえで、医師が裁量により治療方法を決定することを前提に患者の意思決定の対象を治療行為の受入れに限定する見方と、患者の意思決定が治療方法の決定にも及ぶことを前提にその限りで医師の裁量を限定する見方とを対比しつつ、患者が明確な指図を行った場合に、医師はその医学的見解に反して患者の意思に沿う治療行為を行う義務をいかなる理論の下でいかなる範囲で免れることができるか、患者の意思決定を治療方法の決定に及ぼす枠組みの下では医師に過剰な説明義務を生じる可能性があるが、医師の説明義務の範囲をどのように限定し得るかについて明らかにした。
