研究計画の初年度となる2022年度の目標は「保証的制度の利用場面の分類=検討の基準枠の設定への取組み」であった。ここにおいては、「保証（保障）」の名の下で利用されている“人的担保的な”仕組みを網羅的に観察することを踏まえ、少なくとも、民法ないし法律上の「保証」として位置付けられるものと、そうでないもの（「保証的制度」という）とを二分した上で、特に、後者（保証的制度）の社会における利用実態を分析し、一定の共通枠組み（基準枠）を抽出し、制度を分類することが目指されていた。これは、2023年度以降に目指される「非金銭担保機能の抽出と法的評価=保証的制度の法的構造の明確化への取組み」の前提作業として実施されるものであり、その成果自体を公表することは性質上、困難ではあるけれども、2023年度以降のいわば本体的研究の成果公表の際に少なくとも資料の性格をもって内包（提示）される予定である。本研究課題の遂行にあたっては、老人ホームや病院といった保証的制度に関連する施設への実地調査やインタビューも実施することが有益であり、2022年度の研究計画にもこれが期待されていた。具体的な調査を実施することはできなかったものの、地域医療に精通している医師会の医師に研究計画の実施に係る協力を依頼し同意を得られたことは大きな成果となる。また、保証的制度の一断面となる奨学金訴訟をめぐる重要判決の分析や、保証的制度を理論面から観察した場合に避けて通れない意思表示理論や代理制度（委任制度）をめぐる分析につき、2023度以降の準備作業として実施し、成果を公表できたことも今後の円滑な研究計画の推進への助けとなった。あわせて、“人的担保的な”仕組みの網羅的観察という視点からは、より広く担保制度全体をめぐる近時の判例の動向をめぐる分析も行い、成果を公表している。
