项目摘要

本年度は、不正競争防止法における「限定提供データ」の保護制度について、保護対象と侵害範囲に関する国内文献の調査・研究を行った。研究代表者が、立法経緯を含めた各概念の解釈に関する学説の見解等について精査し、検討を行ったほか、令和５年３月に、限定提供データの定義規定にかかる改正案を含む「不正競争防止法等の一部を改正する法律案」が閣議決定されたことから、同改正案に関する議論の経緯等についても、あわせて調査・分析を行った。研究分担者においては、近時、営業秘密に関する刑事裁判例の蓄積がみられることから、これらの裁判例に関する調査・分析を行い、営業秘密保護規定における議論や問題点について検討し、これらと限定提供データ保護規定との比較を通じて、限定提供データの保護に対する示唆等を整理し、研究代表者と共有した。そのうえで、限定提供データにおいて刑事的規制を導入するとした場合に問題となり得る論点等の整理と検討を行った。その結果、保護対象とする情報（営業秘密、限定提供データ）の確定や侵害となる行為の特定などについて、さらに詳細な検討が必要であることが明らかとなった。また、限定提供データに係る裁判例は、いまだ公刊されていないことから、実務の状況については、大学の研究データの利活用の動向に焦点をあてて、主に、大学における研究データの管理・共有の在り方や利用にかかる近時の議論、及び、産学連携における契約上の対応等を対象として調査を行った。
