適格消費者団体の差止請求関係業務に関連する文献や、立法過程における研究会等での議論に関する公表資料等収集・分析を進めてきたが、本研究課題に直接関連する適格消費者団体の差止請求訴訟における立証負担の軽減に関連する現時点での立法的な解答として、令和4年法律第59号（令和4年6月1日公布）により消費者契約法の一部改正が行われた（令和5年6月1日施行）。しかしながら、適格消費者団体から事業者に対する消費者契約の条項の開示要請、損害賠償の額を予定する条項等に関する説明の要請、差止請求に係る講じた措置の開示要請と、これらを受けた事業者に要請に応じる努力義務が明示されるにとどまっており（12条の3から12条の5まで）、十分な実効性を期待しがたい内容に止まっていることが判明した。差止請求関係業務の実態調査に向けて、事業者への申入れや提訴に先立つ事前請求、差止請求訴訟が提起された事案については訴訟の経過等に関して、各適格消費者団体や消費者庁のHP等で公表されている情報の収集・分析を進めている。事案の中には、中小事業者や個人事業者など、事業者側も不当条項との認識がないまま問題のある条項を使用していたものが、事前請求に至る前の申入れを受けて、直ちに改善が図られたという、いわば「法の不知」ともいうべき事例も散見された。なお、HP上での情報の公表態様が適格消費者団体ごとにまちまちであり、特に事案を区別することなく時系列に蓄積されている態様のものが多数であったため、事案ごとに適格消費者団体と事業者との間の交渉過程を復元する作業に思いの外、困難をきたしたため、本年度内にインタビュー調査に着手することができなかった。
