本研究は、ドイツ法およびEU法において導入されている、著作者契約法における相当報酬理論について、学術の発展、文化の多様性を促進する立場から、情報技術社会のイノベーションとともに変容している著作権制度の将来の方向性を意識しつつ、日本法への適用可能性についての理論的考察を目的とするものである。本研究課題を推進するために、2022年度は、デジタル環境下で飛躍的に増加している著作物の利用に対する対価としての相当報酬制度を理論的に分析するとともに、著作者の契約上の地位を保障する著作者契約法の観点から、ドイツ著作権法における具体的な法規定を受けて策定されたEUデジタル域内市場（DSM）指令によって採用された相当報酬理論について理論的研究を行なった。当初の研究実施計画にもとづき、相当報酬理論を理解する上で不可欠な著作者の権利の性質について、ドイツ法を中心とした基礎研究を重点的に行なった。著作権法の現代化のなかで変容する著作者の権利の性質については、ドイツおよびEU諸国と日本とでは温度差があり、相当報酬理論に対する認識に違いがあることを確認した。今年度の研究実績として、国際著作権法学会への出席および滞在研究を行ない、国際的な議論状況の把握に努めた。また、ドイツ法およびEU法に関する相当報酬理論および著作者契約法をテーマとする2本の論文を公表するとともに、著作権管理団体のウェブサイトにおいて、今回の研究テーマを中心に、ドイツ著作権法に関する解説記事を配信している。

This study aims at introducing the German Law and EU Law into China, examining the theory of equivalent remuneration in the author contract law, academic development, cultural diversity promotion, awareness of the future orientation of the work system in the information technology society, and the possibility of application of Japanese Law. This research topic advances in 2022, and the author's contract law points out that the author's contract status is guaranteed. The specific legal provisions of the European Union's (EU) Regional Market (DSM) Directive are subject to the adoption of equivalent pay theory and theoretical research. In the beginning, the research plan was implemented to understand the nature of the author's benefits and the basic research. The modernization of the law of work and the nature of the author's interests are recognized in the understanding of temperature differences between Japan and EU countries and in the theory of equivalent remuneration. This year's research achievements, international work law society attendance, research progress, international discussion situation 2. This paper is published on the basis of the theory of equivalent remuneration and the author's contract law.
