本研究では、法律専門職によるリーガルアドボカシーとの比較検討が可能な法定後見活動の分析をとおして、独立型社会福祉士による本人を中心としたソーシャルワークアドボカシー実践モデルの構築を行うことを目的としている。令和４年度は、アンケート票およびインタビューガイドの作成にむけ、法定後見活動およびアドボカシーに関する先行研究のレビューを行い、以下４点を確認した。第１に、ソーシャルワーク領域においてアドボカシーの議論が活発に行われた1960年代以降のアメリカにおける議論の変遷を検討し、アドボカシー概念を構成する主要な項目として「対象」「関係性」「介入の範囲」「戦術」「種類」の５つを抽出した。第２に、国内外のソーシャルワーク領域のアドボカシーの定義を整理し、法定後見活動におけるアドボカシーの特徴として、①法定後見活動でのアドボカシーをクライエントとのパートナーシップ関係を基本に個人に対するケースアドボカシーから社会システムの変革を行うクラスアドボカシーまでの一連の過程を含むこと、②被後見人の権利回復や救済に限定せず被後見人の意思形成や意思実現に向けた環境整備も含むことを確認した。第３に、イギリスおよびドイツとの成年後見制度の比較検討から、わが国の法定後見活動の構造を明らかにし、従来の民法858条にもとづく「財産管理」「身上監護」の整理ではなく、わが国の法定後見活動の実情に応じた「基本的後見活動」「付加的後見活動」に再整理する必要性を確認した。第４に、国内外の文献レビューからアドボカシーの種類を整理し、専門職アドボカシーに位置づけられるソーシャルワークアドボカシーとリーガルアドボカシーを中心として他のアドボカシーとの関連を図示し、法定後見活動におけるソーシャルワークアドボカシーの有効性を確認した。

This study is aimed at analyzing legal hindsight activities and independent social well-being. The following four points are confirmed during the preparation of the annual report, the statutory review activities and the review of the annual report. Comparative study of adult hindsight system, structure of legal hindsight activities in China, and confirmation of necessity of reorganization of "property management" and "personal guardianship" in the actual situation of legal hindsight activities in China. The fourth part is to sort out the types of display and to confirm the effectiveness of the display in the literature at home and abroad, and to confirm the position of the display and the relationship between the display and the legal activities.
