日本の精神医療は多くの課題を抱えている。特に、精神科病院における非自発的入院は、入退院の基準が曖昧で、長期化しやすく、また、入院者のための権利擁護機関として設置されている精神医療審査会が十分に機能していないことが指摘されている。本研究は、オーストラリア・ニューサウスウェールズ州を参考に、準司法機関であるMental Health Review Tribunalおよび、法的援助機関Legal Aid NSWのしくみと実践を詳細に把握し、特に、運用面の利点と課題を抽出することを目的の一つとする。令和4年にTribunalとLegal Aid NSWで聞き取り調査を実施し、実際のヒアリングに参加した。ヒアリングとは非自発的入院者に対し定期的に実施される聞き取り調査である。弁護士、精神科医、適切な資格を有する3名のパネルが、入院者と入院者側弁護士、主治医、状況により家族やピアサポーターらの発言を聞き取る。参加したヒアリングはTribunalの一室と、入院先の精神科病院を通信機器でつなぎ、入院者とその関係者の発言を聴くことができた。約30分程のヒアリングののち、入院継続の妥当性を判断し、入院者に結論が伝えられた。入院者の権利を擁護する弁護士はLegal Aid NSWから無料で派遣され、入院者は自分の希望を自ら発言するだけでなく、弁護士の助力を得ることができる。弁護士を権利擁護者として利用するサービスは入院者の資力に関わりなく誰もが等しく保障されている。日本の精神医療審査会の場合、定期の調査は年間約27万件実施され、ほぼすべてが書面審査である。退院請求や処遇改善請求の場合はヒアリングが実施されるが、弁護士が同席するとは限らない。対するニューサウスウェールズ州の場合、非自発的入院は入院者の権利を侵害するものであり、可能な限り最小限とするためのしくみが整っていることが理解できた。
